Platform Terms of Service

These terms govern your use of the marketplace platform operated by Daniel Pelikan, trading as Pelikano Online, Oberfeldstrasse 62b/1, 4600 Wels, Austria. They are separate from each seller's own General Terms (AGB) and returns policy, which govern the contract of sale between you and that seller.

1. The platform's role

We provide a curated marketplace where vetted, independent Maekers ("sellers") offer handmade goods. A contract of sale is concluded directly between the buyer and the seller, not with us. The seller is the merchant of record, is responsible for the goods, for issuing any invoice, for VAT where applicable, and for their own terms and returns policy.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You can export your data or delete your account at any time from your account page; transaction records are retained where the law requires.

3. Seller vetting

Sellers are manually reviewed before approval. Approval reflects our vetting at a point in time and is not a guarantee; we may suspend or remove a seller or listing that breaches these terms or the law.

3a. Application fee

Submitting a seller application requires a one-time application fee of € 20.00 excl. VAT (VAT is added where applicable; for VAT-registered businesses in other EU member states the reverse-charge mechanism applies). The fee pays for the manual review of your application — identity and proof-of-handicraft checks — and is non-refundable regardless of the outcome, including if the application is declined. An invoice is issued on payment and sent to your account email address.

The review begins once the fee is paid. By submitting an application you expressly request that we begin performing this service immediately; once the review has been fully performed, a consumer's statutory 14-day right of withdrawal lapses (Art. 16(a) Directive 2011/83/EU / § 18 (1) Z 1 FAGG). Discount voucher codes, where issued by us, reduce the fee by the stated percentage; a 100% voucher waives it.

A fee paid by mistake for a duplicate charge (e.g. a double payment for the same application) is refunded — the non-refundability covers the review service, not accidental double charges.

4. Payments

Payments are processed by Stripe directly to the seller's connected account. We charge sellers a commission on completed sales. We never store full card details.

5. Acceptable use

Don't use the platform unlawfully, infringe others' rights, attempt to disrupt or circumvent its security, or list prohibited or misrepresented goods (see our Prohibited & Restricted Items policy).

6. Liability

To the extent permitted by law, we are not a party to the sale and are not liable for the goods themselves. Mandatory statutory consumer rights against the seller are unaffected.

7. Changes

We may update these terms; material changes will be notified. Continued use after a change constitutes acceptance.
